Cadar Wajib atau Sunnah Untuk Wanita?
Shafi'i School of Religion
The opinion of the Shafi'i
school, the woman's nakedness in front of the man ajnabi (not mahram) is the
whole body. So they require women to wear a veil in front of a man ajnabi. This
is the opinion of mu'tamad Syafi'i madzhab.
* Asy Syarwani said:
إن لها ثلاث عورات: عورة في الصلاة
، وهو ما تقدم ـ أي كل بدنها ما سوى الوجه والكفين. وعورة بالنسبة لنظر الأجانب إليها:
جميع بدنها حاى الوجه والكفين على المعتمد وعورة في الخلوة وعند المحارم: كعورة الرجل
»اهـ ـ أي ما بين السرة والركبة ـ
"Women have three types of
genitals, (1) aurat in prayer - as explained - namely the entire body except
the face and palms, (2) the nakedness of the view of the ajnabi man, which is
the whole body including the face and palms, in your opinion ' tamad, (3) aurat
when both together are mahram, just like men, namely between navel and thighs
"(Ash Syarwani Prayer 'Ala Tuhfatul Muhtaaj, 2/112)
* Syaikh Sulaiman Al Jamal said:
غير وجه وكفين: وهذه عورتها في الصلاة.
وأما عورتها عند النساء المسلمات مطلقًا وعند الرجال المحارم ، فما بين السرة والركبة.
وأما عند الرجال الأجانب فجميع البدن
"The meaning of An Nawawi's
words" women's genitals are other than faces and palms, "this is the
aurat in prayer. The absolute aurat of Muslim women before a man who is still
mahram is between the navel to the thigh. Whereas in front of men who are not
mahram are all bodies "(Hasyiatul Jamal Ala’ Syarh Al Minhaj, 411)
* Shaykh Muhammad bin Qaasim Al
Ghazzi, author of Fathul Qaarib, said:
وجميع بدن المرأة الحرة عورة وكفيها
، وهذه عورتها في الصلاة ، أما خارج الصلاة فعورتها جميع بدنها
"All women's bodies besides
their faces and palms are genitals. This is the aurat in prayer. As for outside
prayer, women's genitals are all bodies "(Fathul Qaarib, 19)

* Ibnu Qaasim Al Abadi said:
فيجب ما ستر من الأنثى ولو رقيقة ما
عدا الوجه والكفين. ووجوب سترهما في الحياة ليس لكونهما عورة ، بل لخوف الفتنة غالبًا
"It is mandatory for a woman
to cover the entire body other than the face of the palm, even though the cover
is thin. And it is also obligatory to cover your face and palms, not because
both are aurat, but because in general they tend to cause slander "(Ibn

* Taqiyuddin Al Hushni, author
Kifaayatul Akhyaar, said:
ويكره أن يصلي في ثوب فيه صورة وتمثيل,
والمرأة متنقبة إلا أن تكون في مسجد وهناك أجانب لا يحترزون عن النظر, فإن خيف من النظر
إليها ما يجر إلى الفساد حرم عليها رفع النقاب
"The law of prayer is to
wear clothes with pictures or paintings. Makruh also wears niqab (veil) when
praying. Unless the mosque is in a difficult condition to keep from the sight
of the Ajnabi man. If the woman is worried that she is seen by the Ajnabi man
to cause damage, it is forbidden to give up the niqab (veil) "(Kifaayatul
Akhyaar, 181)

Hambali school
* Imam Ahmad bin Hambal said:
كل شيء منها ــ أي من المرأة الحرة
ــ عورة حتى الظفر
"Every part of a woman's
body is aurat, including her nails" (Dinukil in Zaadul Masiir, 6/31)
* Syaikh Abdullah bin Abdil Aziz
Al ‘Anqaari, author of Raudhul Murbi ', said:
«وكل الحرة البالغة عورة حتى ذوائبها
، صرح به في الرعاية. اهـ إلا وجهها فليس عورة في الصلاة. وأما خارجها فكلها عورة حتى
وجهها بالنسبة إلى الرجل والخنثى وبالنسبة إلى مثلها عورتها ما بين السرة إلى الركبة
"Every part of a woman's
body that is baligh is aurat, including the angle of her head. This opinion has
been explained in the book Ar Ri'ayah ... except the face, because the face is
not aurat in prayer. As for outside prayer, all parts of the body are genitals,
including the face if in front of a man or in the presence of a sissy. If in
the presence of fellow women, the genitals between the navel to the thighs
"(Raudhul Murbi’, 140)
* Ibnu Muflih said:
«قال أحمد: ولا تبدي زينتها إلا لمن
في الآية ونقل أبو طالب: ظفرها عورة, فإذا خرجت فلا تبين شيئا, ولا خفها, فإنه يصف
القدم, وأحب إلي أن تجعل لكمها زرا عند يدها
"Imam Ahmad said:‘ The
purpose of the verse is, let them not show their jewelry except to the person
mentioned in verse ‘. Abu Talib quoted an explanation from him (Imam Ahmad):
‘Female nails including aurat. If they come out, they may not show anything
even khuf (a kind of sock), because the khuf still reveals a curve of the foot.
And I prefer if they make a kind of press button on the hand '' (Al Furu ’,
601-602)
* Syaikh Manshur bin Yunus bin
Idris Al Bahuti, when explaining matan Al Iqna ', he said:
«وهما» أي: الكفان. «والوجه» من الحرة
البالغة خارجها »أي الصلاة« باعتبار النظر كبقية بدنها »
"'Both, namely two palms and
faces are the genitals outside the prayer because of the view, just like other
limbs" (Kasyful Qanaa ’, 309)
* Shaykh Muhammad bin Salih Al
Utsaimin said:
القول الراجح في هذه المسألة وجوب ستر
الوجه عن الرجال الأجانب
"A strong opinion on this
issue is obligatory for women to cover their faces than men

Maliki School of Religion
The Maliki School believes that a
woman's face is not aurat, but uses the sun's veil (recommended) and becomes
obligatory if it is feared to cause slander. Even some of Maliki's scholars
argue that a woman's whole body is aurat.
* Az Zarqaani said:
وعورة الحرة مع رجل أجنبي مسلم غير
الوجه والكفين من جميع جسدها ، حتى دلاليها وقصَّتها. وأما الوجه والكفان ظاهرهما وباطنهما,
فله رؤيتهما مكشوفين ولو شابة بلا عذر من شهادة أو طب, إلا لخوف فتنة أو قصد لذة فيحرم,
كنظر لأمرد, كما للفاكهاني والقلشاني
"The woman's aurat in front
of the Ajnabi Muslim man is the whole body besides the face and palms. Even the
beautiful voice is also aurat. Whereas the face, the outer and inner palms, may
be displayed and seen by men even though the woman is still young both just looking
or for medicinal purposes. Unless you are concerned about arising slander or a
man seeing a woman for delicious taste, then the law is haraam, as forbidden to
see Amraad. This was also expressed by Al Faakihaani and Al Qalsyaani
"(Syarh Mukhtashar Khalil, 176)
* Ibnul Arabi said:
عبدالها عليها ء أو لحاجة ء أو لحاجة
ء أو لحاجة داي يكون ببدنها ع أو سؤالها عما يَعنُّ ويعرض عندها
"The woman is entirely
aurat. Both his body and his voice. It is not permissible to show his face
except an emergency or an urgent need such as a witness or treatment on his
body, or we are questioned whether he is the person in question (in an issue)
"(Ahkaamul Qur'an, 3/1579)
* Al Qurthubi said:
قال ابن خويز منداد وهو من كبار علماء
المالكية: إن المرأة اذا كانت جميلة وخيف من وجهها وكفيها الفتنة, فعليها ستر ذلك;
وإن كانت عجوزا أو مقبحة جاز أن تكشف وجهها وكفيها
"Ibn Juwaiz Mandad - he is a
great scholar of Maliki - said: If a woman is beautiful and worries about her
face and palms causing slander, she should cover her face. If he is an old
woman or her face is ugly, it may be possible for her to show her face ”(Tafsir
Al Qurthubi, 12/229)
* Al Hathab said:
واعلم أنه إن خُشي من المرأة الفتنة
يجب عليها ستر الوجه والكفين. قاله القاضي عبد الوهاب ، ونقله عنه الشيخ أحمد زرّوق
في شرح الرسالة ، وهو ظاهر التوضيح
"Know, if it is feared that
slander will occur, women must cover their faces and palms. This was said by Al
Qadhi Abdul Wahhab, also quoted by Syaikh Ahmad Zarruq in Syarhur Risaalah. And
this is a more appropriate opinion "(Mawahib Jaliil, 499)
* Al Allamah Al Banaani, explains
the opinion of Az Zarqani above:
وهو الذي لابن مرزوق في اغتنام الفرصة
قائلا: إنه مشهور المذهب, ونقل الحطاب أيضا الوجوب عن القاضي عبد الوهاب, أو لا يجب
عليها ذلك, وإنما على الرجل غض بصره, وهو مقتضى نقل مواق عن عياض. وفصَّل الشيخ زروق
في شرح الوغليسية بين الجميلة فيجب عليها ، وغيرها فيُستحب
"This opinion was also said
by Ibn Marzuuq in the Ightimamul Furshah book, he said:‘ This is a famous
opinion in the Maliki school. Al Hathab also quoted Al-Qadhi Abdul Wahhab's words
that the law was mandatory. Some of the Maliki scholars mentioned the opinion
that the law was not compulsory but men were obliged to bow their eyes. This
opinion was quoted by Mawwaq from Iyadh. Syaikh Zarruq in the Syarhul
Waghlisiyyah book details, if it is beautiful then it is obligatory, if it is
not beautiful, then the sunnah "(Hasyiyah‘ Ala Syarh Az Zarqaani, 176)

Hanafi School of Religion
The opinion of the Hanafi school
of thought, the face of a woman is not aurat, but uses the legal veil of the
sunnah (recommended) and becomes obligatory if it is feared to cause slander.
* Asy Syaranbalali said:
وجميع بدن الحرة عورة إلا وجهها وكفيها
باطنهما وظاهرهما في الأصح ، وهو المختار
"The whole body of a woman
is naked except for her face and deep palms and outer palms, this is a more
valid opinion and is our choice of madzhab" (Matan Nuurul Iidhah)
* Al Imam Muhammad ‘Alaa-uddin
said:
وجميع بدن الحرة عورة إلا وجهها وكفيها,
وقدميها في رواية, وكذا صوتها, وليس بعورة على الأشبه, وإنما يؤدي إلى الفتنة, ولذا
تمنع من كشف وجهها بين الرجال للفتنة
"All female bodies are naked
except for the face and deep palms. In a history, also the outer palm. Likewise
his voice. But it is not aurat if it is before a fellow woman. If it tends to
cause slander, it is forbidden to show his face in the presence of men
"(Ad Durr Al Muntaqa, 81)
* Al Allamah Al Hashkafi said:
والمرأة كالرجل ، لكنها تكشف وجهها
لا رأسها ، ولو سَدَلَت شيئًا عليه وَجَافَتهُ جاز ، بل يندب
"The woman's aurat in prayer
is like a man's nakedness. But the woman's face was opened while her head was
not. If a woman uses something on her face or closes it, it may, even be
recommended "(Ad Durr Al Mukhtar, 2/189)
* Al Allamah Ibn Abidin said:
تُمنَعُ من الكشف لخوف أن يرى الرجال
وجهها فتقع الفتنة ، لأنه مع الكشف قد يقع النظر إليها بشهوة
"Forbidden for women to show
their faces for fear that they will be seen by men, then slander arises.
Because if the face is shown, sometimes the man sees it with lust
"(Hasyiah‘ Alad Durr Al Mukhtaar, 3/188-189)
* Al Allamah Ibn Najiim said:
قال مشايخنا: تمنع المرأة الشابة من
كشف وجهها بين الرجال في زماننا للفتنة
"Our Muslim scholars say
that it is forbidden for young women to show their faces in front of the men of
our time, because it is feared to cause slander" (Al Bahr Ar Raaiq, 284)
He said so in his day, that he
died in 970 AH, what about our age?

Veil Is Islamic Culture
From the explanation above, it is
clear that wearing veils (and also headscarves) is not just east-central
culture, but Islamic culture and Islamic teachings that have been taught by
Islamic scholars as heirs of the Prophets who teach all Muslims, not to the
eastern community - just take it. If indeed this Islamic culture has been
regarded as a local culture by the middle-eastern community, then of course
this is a good thing. Because rightly so, a Muslim is an Islamic culture.
Among other evidence that the
veil (and also the headscarf) is Islamic culture:
1. Before going down the verse
which commands hijab or veiling, the culture of the Jahiliyah Arab community is
to show genitals, preening when going out of the house, dressed in seronok or
called tabarruj. Therefore Allah Ta'ala said:
وَقَرْنَ فِي بُيُوتِكُنَّ وَلَا تَبَرَّجْنَ
تَبَرُّجَ الْجَاهِلِيَّةِ الْأُولَىٰ
"You (Muslim women) should
be in your homes and do not tabarruj as did the previous ignorant woman"
(Surat al-Ahzab: 33)
Whereas, what is called jahiliyah
is the time when Rasulullah Shallalahu’alihi Wasallam has not been sent. When Islam
comes, Islam changes this bad culture by ordering women to wear hijab. This
proves that the hijab or headscarf is a culture that originates from Islam.
2. When descending the verse of
the hijab, Muslim women who believe in the Messenger of Allah Shallalahu'alaihi
Wasallam at once they are looking for any cloth that can cover their nakedness.
‘Aisyah Radhiallahu’anha said:
مَّا نَزَلَتْ هَذِهِ الْآيَةُ (وَلْيَضْرِبْنَ
بِخُمُرِهِنَّ عَلَى جُيُوبِهِنَّ) أَخَذْنَ أُزْرَهُنَّ فَشَقَّقْنَهَا مِنْ قِبَلِ
الْحَوَاشِي فَاخْتَمَرْنَ بِهَا
"(Women of the Emigrants),
when descending this verse:" And they shall cover the veil to their chest
(and neck). "(QS. An Nuur: 31), they tear their blankets and they veil
with them." (HR Bukhari 4759)
Shows that they were not clothed
before covering their genitals so they used the cloth in order to obey the
verse.
In short, the scholars have long
discussed the law of wearing veils for women. Some require, and some argue that
the law is sunnah. None of them said that this discussion only applies to Arab
or Middle Eastern Muslim women. So it is not true that wearing the veil is
strange, extreme, excessive in religion, or part of the culture of the Arab
country.
